ATS Subscriber Termination on August 19 and ATS Ceases Operation on September 2

Overview

Per IEX Trading Alert #2016-037, IEX ATS Subscribers who are not approved Investors Exchange Members or have not submitted the necessary Connectivity Agreements and Forms with Investors Exchange will have their access terminated for order entry prior to the start of trading on Friday, August 19, 2016. Additionally, access to TOPS v1.4 will be terminated for ATS Data Subscribers who are not Investors Exchange Data Recipients on Friday, September 2, 2016.

In connection with the launch of the Investors Exchange, the IEX ATS will cease operations on September 2. Therefore, as previously communicated, please note that all Subscriber Agreements, Service Bureau Agreements, Data Agreements, and Connectivity Services Agreements with IEX for the IEX ATS will be terminated effective on September 2, 2016. The ATS agreement terminations will have no effect on any agreements with Investors Exchange.

Investors Exchange Membership, Data, and Connectivity

Current IEX ATS Subscribers must have the below agreements and forms with Investors Exchange submitted and approved prior to the Launch Date, Friday, August 19, for continued access to order entry and drop copy on IEX, and prior to Friday, September 2 for continued access to TOPS v1.4.

If an applicant broker-dealer has not been approved as a member of Investors Exchange prior to the Launch Date, the applicant broker-dealer will not be eligible to enter orders on Investors Exchange until member approval is granted. If a user has not been approved as a recipient of Investors Exchange data, the user will not be eligible to receive data from Investors Exchange until approval is granted.

Waive-In Member Application

Current ATS Subscribers may use the Waive-In Member Application until 90 days after Exchange approval (i.e., September 15, 2016). After such date, applicant broker-dealers must all use the Member Application.
